What is Probate in Alabama Law?

The word ‘probate’ loosely translates to ‘prove.’ So, in law, probate is the legal court process of settling a decedent’s estate and ensuring that the belongings left behind go to the rightful persons. Probate is not always mandatory. In Alabama, probate is necessary if the decedent had any probate assets – properties and accounts that didn’t automatically pass on to a beneficiary after death. If a person leaves little or nothing after death or has non-probate assets, the process may not be necessary.

If your loved one left a will, the probate process is typically easier. On the other hand, if your loved one died intestate (i.e., with no written will), then the probate court assigns an estate administrator and executor to help you get everything in order. As your estate administration attorneys, we will help you show that the will is self-proving and was created with Alabama law.

What is Estate Administration?

Estate administration is a process of settling a decedent’s estate and includes: accounting for all assets, paying outstanding liabilities and estate taxes, and passing on assets to the beneficiaries. Estate administration is handled by an estate administrator, usually appointed by the deceased or the Alabama Probate Court – such as the Probate Court of Jefferson County. This process is typically necessary, whether you go to probate court or not. The probate and estate administration laws in Alabama can be rather complex. You’ll first have to determine whether to go through probate or not, and that means looking through all the deceased assets and differentiating probate and non-probate assets. If your loved one had a sizeable and varied estate, this process may be time consuming. Additional potentially complicating factors include handwritten wills, which may not be considered legal under Alabama law. Therefore, probate lawyers can prove invaluable in efficiently navigating the probate process.
